These Terms of Use ("Terms") govern your access to and use of our Chrome extension and related services (collectively, the "Services"). 1. Our Services
Our Services provide AI-powered tools designed to enhance your browsing experience by facilitating seamless interaction with Large Language Models (LLMs) of your choice. This includes enabling context-aware conversations with AI models using website content, providing a unified interface for multiple AI providers, and enhancing productivity through AI-assisted browsing.
SurfMind is available as:
- Chrome browser extension available through the Chrome Web Store
- Related web services and support platforms
The Services are designed with privacy-first principles, ensuring all website content processing occurs locally within your browser. The Services are not designed to comply with industry-specific regulations (e.g., HIPAA, FISMA) and should not be used where such compliance is required.
2. Intellectual Property Rights
2.1 Our Content
All software, code, design, trademarks, and other materials provided by us are owned or licensed by SurfMind and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to access and use the Services for lawful purposes in accordance with these Terms.
2.2 AI-Generated Content
Content generated through your interaction with third-party AI providers via our Services is subject to the terms and conditions of those respective AI providers. SurfMind does not claim ownership over content generated by third-party AI services. Your rights to such content are governed by the terms of service of the specific AI provider you choose to use (e.g., OpenAI, Anthropic, Google).
2.3 User Content
You retain ownership of any content you input into the Services. However, you grant us a limited license to process such content as necessary to provide the Services, including facilitating communication with your chosen AI providers.
3. User Inputs and Submissions
You represent and warrant that you have the legal right to use any input you submit to the Services, including website content you choose to share with AI providers. You are solely responsible for ensuring that your use of the Services and any resulting output does not violate applicable laws or the rights of others.
You acknowledge that:
- Content you share with AI providers through our Services is subject to their respective privacy policies and terms of service
- You are responsible for reviewing and complying with the terms of any third-party AI services you use
- SurfMind acts solely as a facilitator and does not control or monitor the content of your interactions with AI providers
By submitting feedback or suggestions about our Services, you grant us a perpetual, royalty-free license to use that feedback for any purpose without compensation.
4. Third-Party AI Services
Our Services facilitate access to third-party AI providers including but not limited to OpenAI, Anthropic (Claude), and Google (Gemini). Your use of these AI services is subject to their respective terms of service and privacy policies:

You are responsible for obtaining and maintaining valid accounts and API access with these providers. SurfMind is not responsible for any disruptions, limitations, or changes to third-party AI services.
5. User Responsibilities and API Management
When using our Services, you are responsible for:
- Maintaining the confidentiality and security of your API keys and credentials
- Managing your usage and associated costs with third-party AI providers
- Ensuring compliance with the rate limits and usage policies of AI providers
- Monitoring your API usage and associated charges from third-party services
- Keeping your browser and the extension updated for optimal security and performance
6. Acceptable Use
You agree not to:
- Use the Services in a manner that violates any applicable law or regulation
- Upload, input, or transmit content that is illegal, harmful, threatening, abusive, defamatory, or infringes on any rights
- Reverse engineer, decompile, disassemble, or attempt to extract source code from the Services
- Use the Services to access or interact with websites or content without proper authorization
- Attempt to circumvent, disable, or interfere with security-related features of the Services
- Use the Services in any manner that could damage, disable, overburden, or impair our systems
- Share, distribute, or misuse API keys or credentials belonging to others

- Any guarantee of accuracy, completeness, or reliability of AI-generated content
- Continuous, uninterrupted, or error-free operation of the Services
- Compatibility with all websites, browsers, or systems
- The availability, performance, or terms of third-party AI services
Content generated by AI services is for informational purposes only and is not a substitute for professional advice. You are solely responsible for verifying the accuracy and appropriateness of any AI-generated output and for compliance with applicable laws and regulations.
9. Limitation of Liability
To the fullest extent permitted by applicable law, SurfMind and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your use or inability to use the Services
- Damages resulting from any third-party AI service disruptions or changes
- Costs associated with third-party AI service usage
- Unauthorized access to or alteration of your transmissions or data
10. Indemnification
You agree to indemnify, defend, and hold harmless SurfMind and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:
- Your use of the Services in violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any rights of another party
- Your use of third-party AI services through our platform
11. Termination
We reserve the right to suspend or terminate your access to the Services at our sole discretion, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Suspected fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Technical or security reasons
Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

SurfMind LLC is a Delaware limited liability company. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.
The arbitration shall be conducted in Dover, Delaware, or via remote proceedings as agreed by the parties. The arbitrator's decision shall be final and binding, and judgment may be entered upon it in any court having jurisdiction.
14. General Provisions
These Terms constitute the entire agreement between you and SurfMind regarding the Services. If any provision of these Terms is found to be unenforceable, the remainder shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
